1. Acceptance of Terms
By accessing or using VisualStore ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
2. Description of Service
VisualStore is an online marketplace that connects creators of visual content (video loops, VJ plugins, effects packs, UI kits) with buyers. We facilitate transactions but are not a party to the sale agreement between creators and buyers.
3. Account Registration
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to create an account.
- One person or entity may only maintain one account.
4. Buyers
- All purchases are final and subject to our License Agreement.
- You receive a license to use purchased content, not ownership of the intellectual property.
- Refund requests are evaluated case-by-case within 48 hours of purchase.
- You may not share, redistribute, or resell purchased files.
5. Creators
- You must own all rights to the content you upload, or have explicit authorization to sell it.
- All submissions are subject to review and may be rejected if they violate our Creator Guidelines.
- VisualStore retains a 15% platform commission on each sale. The remaining 85% is paid to you via Stripe Connect.
- You grant VisualStore a non-exclusive license to display, promote, and distribute previews of your content on the Platform.
- You may remove your products at any time, but existing buyers retain their licenses.
6. Payments
- All payments are processed securely through Stripe.
- Prices are displayed in EUR. Currency conversion is handled by Stripe for international transactions.
- Creator payouts are processed via Stripe Connect to the bank account linked during onboarding.
- VisualStore is not responsible for Stripe fees, bank fees, or currency conversion costs.
7. Intellectual Property
The VisualStore name, logo, design, and codebase are the property of VisualStore. All user-generated content remains the intellectual property of its respective creators.
8. Prohibited Conduct
- Uploading malware, spam, or fraudulent content.
- Impersonating another person or entity.
- Attempting to circumvent payment or licensing systems.
- Scraping or automated data collection from the Platform.
- Using the Platform for any illegal purpose.
9. Termination
We reserve the right to suspend or terminate any account that violates these Terms, at our sole discretion and without prior notice. Banned users may not create new accounts.
10. Disclaimer of Warranties
The Platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the Platform's availability, accuracy, or fitness for a particular purpose.
11. Limitation of Liability
VisualStore shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Platform, including loss of revenue or data.
12. Governing Law
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.
13. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify registered users of significant changes via email.
